Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Gambito (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Dynadel ("we", "us", or "our"), the developer and publisher of Gambito. Your continued use of the App after any modification to these Terms constitutes acceptance of the updated Terms.

2. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App solely for your personal, non-commercial purposes on devices you own or control.

You may not:

  • Copy, modify, distribute, sell, or sublicense the App or any part of it
  • Reverse engineer, decompile, or disassemble the App except to the extent permitted by applicable law
  • Remove or alter any proprietary notices or labels on the App
  • Use the App to develop a competing product or service
  • Use the App in any way that violates applicable laws or regulations

3. App Availability and Changes

We reserve the right, at our sole discretion and at any time without notice, to:

  • Modify, suspend, or discontinue the App or any part of it
  • Add, change, or remove features
  • Issue updates that may alter functionality or require re-acceptance of these Terms

We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

4. Third-Party Components

The App includes third-party software components, including Stockfish and Leela Chess Zero (LC0), which are distributed under their respective open-source licenses. Use of these components is subject to the terms of those licenses, copies of which are included within the App.

We make no representations or warranties regarding the accuracy, reliability, or fitness for purpose of third-party components.

5. User Data and Privacy

Gambito processes all data locally on your device. No gameplay data, analysis results, or puzzle history is transmitted to our servers or third parties. The App does not require an account to operate.

To the extent we collect any information (such as anonymised crash reports or aggregate usage analytics, where permitted by platform policies), such collection is governed by our Privacy Policy. By using the App you consent to data practices described therein.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, free of viruses or other harmful components, or that defects will be corrected. Chess analysis results, engine evaluations, and puzzle ratings are provided for recreational and educational purposes only and should not be relied upon for any other purpose.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DYNADEL, ITS OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify and hold harmless Dynadel and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

9. Intellectual Property

All intellectual property rights in the App, including its design, interface, graphics, code, and content created by us, are owned by or licensed to Dynadel. Nothing in these Terms transfers any such rights to you.

Gambito, the Gambito logo, and Dynadel are trademarks or trade names of Dynadel. You may not use them without our prior written consent.

10. App Store Terms

If you download the App from a third-party app store (such as the Apple App Store or Google Play), the relevant store's terms of service also apply to your use of the App. In the event of any conflict between these Terms and the app store's terms, the app store's terms will govern with respect to their subject matter.

11. Termination

We may terminate or suspend your license to use the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App ceases immediately. All provisions of these Terms that by their nature should survive termination will do so, including warranty disclaimers and limitations of liability.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Dynadel is established, without regard to its conflict-of-law provisions.

Any dispute arising from these Terms or your use of the App shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration under the rules of a recognised arbitral body in Dynadel's jurisdiction, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property matters.

You agree to resolve disputes with us individually and waive any right to participate in class-action proceedings.

13. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. We may also notify you through a notice within the App. Your continued use of the App after any change constitutes acceptance of the revised Terms.

We encourage you to review this page periodically.

14. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision will be modified to the minimum extent necessary and the remaining provisions will continue in full force.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dynadel regarding the App and supersede any prior agreements.
